Terms and Conditions

Prices

BOIA reserves the right, by written notice given to the Buyer at anytime prior to the desired date of dispatch specified in our order acknowledgment, to adjust the price of the goods reference to the any price adjustment by BOIA’s vendor. In this event, the Buyer may request to cancel the order by written notice to BOIA within 5days after receiving a written notice of a price adjustment. In this event, any approval for cancellation will be subject to BOIA’s vendor consent. If BOIA does not receive a written rejection on price change within the 5days period, the price adjustment will become effective at the end of the 5days period. Price quoted is exclusive of GST, taxes, duties and customs fees and are subject to variation in the cost of materials and labour and may be altered at any time before invoicing to reflect such variations. Price lists may be altered at any time without notice.

Payment

Payment of the purchases as per BOIA invoice must be paid in full in advance upon order, shipment or within net 30days from invoice date as per agreed or otherwise stated in the BOIA quotation’s payment terms and condition. BOIA reserves the right to charge a late payment fee, allowable by law on all unpaid late payment. This is subject to an interest calculated based on the interest rate charge by BOIA’s bank plus 4% per annum late payment charges calculated from the due date of unpaid payment. BOIA reserve the right to stop any shipment if either payment limit or payment term is overdue and will not be liable to any lost, result from the stop shipment decision.

Shipment and Delivery

Specified dates of delivery for the goods are approximate only and subject to changes with reference to BOIA vendor shipment schedule. BOIA reserves the right to over ship or under ship and invoice accordingly with reference to product pack size. BOIA shall not be liable for any damage, loss or expense incurred by the Buyer if BOIA fails to meet the specified dates in whole or in part, by any occurrence that is beyond the control of BOIA or its vendor. BOIA reserve the right to levy delivery charges should exceptional economic conditions arise and dictate such action. Any request for proof of delivery must be requested within one calendar month of date of invoice.

Cancellation

All orders and products are non cancellable or otherwise stated in the quotation’s terms and condition. Should there be any agreement on standard cancellation window as per offer, this will only take place upon prior written consent of BOIA or its Vendor.

Return of Goods due to Quality Issue and Limitation of Liability

In the event of any quality issue, the buyer must inform BOIA in writing within 5 days of date of receipt of goods. Failing to report within 5 days, all shipment will deem to be in good condition and accept by Buyer. All return and replacement must adhere to BOIA returns policy. BOIA will not accept any returns of goods without BOIA prior written consent. In the event of any claim against the company in respect of any matter, BOIA liability (if any) shall be limited to the replacement of products sold or the buyer shall be given a credit for the invoiced value of the order, at the sole discretion of BOIA.

Warranty

Our products come with a standard 12 months manufacturer warranty (except for consumable products like batteries, straps, cases, earphones, cables) except otherwise stated.

If your purchase develops a fault after 5 days and within its 12 months warranty, we will arrange to repair and return or replace the product to you free of charge, depending on the manufacturer. It may take up to 28 working days or longer for repairs to be completed, depending on the manufacturer and complexity of the problem (e.g. availability of required parts).

Our warranty does not apply to: a) Damage caused by normal wear and tear, abnormal use or conditions, misuse, neglect, abuse, accident, improper handling or storage, exposure to moisture, unauthorized modifications, alterations, or repairs, improper installation, improper use of any electrical source, undue physical or electrical stress, operator error, non-compliance with instructions or other acts which are not the fault of BOIA, including damage or loss during returning shipment from customers’ returns.
b) Damage from external causes such as floods, storms, fires, sand, dirt, earthquakes, an Act of God, exposure to sunlight, weather, moisture, heat, or corrosive environments, electrical surges, battery leakage, theft, or damage caused by the connection to other products not recommended for interconnection by BOIA.
c) Failure to work and/or lost data due to (i) interoperability with current and/or future versions of operating systems or other current and/or future software and hardware which have not been recommended by the manufacturers of the products, (ii) a computer virus, worm, Trojan horse or memory content corruption, or (iii) malfunction or defect of the product.
d) Any product that has had its serial number altered, defaced or removed.
e) Any defect that is discovered/reported after the expiration of the Warranty Period.

Retention of Title

Property in the goods supplied will not pass in law until full payment for the goods is received. Until payment in full, the buyer shall hold and store at his own expenses the goods on BOIA behalf with licence to use the goods; such licence being revoked automatically on the insolvency of the buyer or expressly by actual revocation. In this event, BOIA reserves the right the enter buyer’s premises, and remove goods to the value of all monies owed by buyer. BOIA should not be in anyway liable for any failure to fulfill or any delay in any obligation arise from this terms and condition if this is cause by event that is not controllable by BOIA.

BOIA reserves the right to modify its Standard Terms and Conditions of Sales without prior notice.
